Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between HomeGo online platform and the users who use the services provided. These Terms govern your access to and use of our websites, mobile applications, APIs, and related services (collectively, the "Platform"). By accessing or using our online Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. 1. Definitions and Interpretation Unless otherwise defined, capitalized terms shall have the meanings set forth below: "Accommodation" means any residential, commercial, or other real property, including rooms or shared spaces, listed on the Platform. "Account" means a registered user account on the Platform. "Booking" means a confirmed reservation of an Accommodation through the Platform. "Content" means all text, images, videos, audio, reviews, ratings, messages, and other materials made available on the Platform. "Guest" means a user who books or intends to book an Accommodation. "Host" means a user who lists an Accommodation on the Platform. "Services" means the Platform and all related services provided by the Company. Headings are for convenience only and do not affect interpretation. 2. Eligibility and User Representations 2.1 Age and Capacity You must be at least 18 years old and legally capable of entering into binding contracts to use the Services. 2.2 Representations and Warranties You represent and warrant that all information you provide is accurate, complete, and not misleading, and that your use of the Platform complies with all applicable local, national and international laws and regulations. 3. Account Registration and Security 3.1 Account Creation Certain features require registration. It is your responsibility to maintain accurate and up-to-date Account information. 3.2 Account Responsibility You are solely responsible for safeguarding your credentials and for all activities conducted through your Account. 3.3 Account Verification We may require identity verification, including submission of government-issued identification, to comply with legal or safety requirements. 4. The role of the Platform The Company provides a neutral technology platform to facilitate connections between Hosts and Guests. We do not own, control, manage, or insure any Accommodations and do not act as an agent, broker, or insurer for any user. Any agreement for accommodation is solely between the Host and the Guest. We make no representations regarding the accuracy, completeness, or usefulness of information provided on the Platform and disclaim responsibility for the reliability or correctness of any opinions, advice, or statements made by parties other than HomeExchange. HomeExchange shall not be held liable for any loss or damage arising from reliance on information or other content published on the Platform or communicated to Members or Registrants. HomeGo does not warrant that the Platform will be available or accessible at all times without interruption. We reserve the right to suspend, restrict, or limit access to the Platform when required to safeguard our servers or to carry out maintenance operations. Any opinions, advice, statements, offers, or other content available on the Platform that are not issued directly by HomeExchange belong solely to their respective authors and do not necessarily reflect our views. 5. Host Obligations 5.1 Listing Accuracy Hosts must ensure listings are accurate, complete, and kept up to date. 5.2 Legal and Regulatory Compliance Hosts are solely responsible for compliance with all applicable laws, including zoning, licensing, safety, housing, tax, and consumer protection requirements. 5.3 Standards and Non-Discrimination Hosts must provide safe, clean, and habitable accommodations and comply with applicable non-discrimination laws. 6. Guest Obligations Guests agree to: Use Accommodations responsibly and lawfully; Respect Host rules and property; Provide accurate booking and payment information; Leave Accommodations in reasonable condition. 7. Bookings, Payments, and Fees 7.1 Booking Formation A Booking is formed upon Host acceptance or instant booking confirmation. 7.2 Payments and Processing The Company does not store full payment card details. 7.3 Service Fees Applicable service fees will be disclosed prior to Booking confirmation. 7.4 Taxes Hosts are responsible for determining and remitting applicable taxes unless the Company is legally required to collect and remit on their behalf. 8. Cancellations, Refunds, and Modifications 8.1 Cancellation Policies Cancellation terms are set by Hosts and Guests and disclosed at the time of Booking. 8.2 Refund Processing Refunds, if applicable, are processed according to the stated cancellation policy. 8.3 Extraordinary Events We may cancel or modify Bookings due to events beyond reasonable control, including natural disasters, public health emergencies, or government actions. 9. User Conduct and Prohibited Activities You agree not to: Violate any law or regulation; Use the Platform for fraudulent or harmful purposes; Circumvent fees or policies; Post unlawful, misleading, or infringing Content; Interfere with Platform security or operations. 10. Content, Reviews, and Intellectual Property 10.1 User Content License By posting Content, you grant the HomeGo platform a worldwide, royalty-free, non-exclusive, sublicensable license to use, host, display, and distribute such Content. 10.2 Reviews Reviews must be honest and based on actual experiences. We may remove reviews that violate our policies. 10.3 Company Intellectual Property All Platform software, trademarks, and branding are owned by or licensed to HomeGo online platform. 11. Insurance and Risk Allocation Users are responsible for obtaining appropriate insurance coverage. To the maximum extent permitted by law, use of the Platform and Accommodations is at your own risk. 12. Disclaimer of Warranties The Platform is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. 13. Limitation of Liability To the maximum extent permitted by law, HomeGo online platform shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits or data. 14. Indemnification You agree to indemnify and hold harmless Homego online platform and its affiliates from claims arising out of your use of the Platform or violation of these Terms. 15. Suspension and Termination We may suspend or terminate Accounts for violations of these Terms, safety concerns, or legal requirements. Users may close their Accounts at any time. 16. Privacy and Data Protection Personal data is processed in accordance with our Privacy Policy, which forms an integral part of these Terms. 17. International Use and Export Controls Users acknowledge that laws vary by jurisdiction and agree to comply with all applicable local and international laws, including export control regulations. 18. Governing Law and Dispute Resolution These Terms are governed in accordance with the governing laws by each country where the hosts who share their accomodations reside. By following the local and national laws and jurisdictions, disputes shall be resolved exclusively through local courts/arbitration, located in local venues as applicable, unless otherwise required by law. 19. Changes to These Terms We may update these Terms, therefore continued use of the Platform after changes constitutes acceptance of the revised Terms. 20. Miscellaneous Entire Agreement: These Terms constitute the entire agreement between the user of the services provided by the HomeGo online platform. Assignment: You may not assign your rights without our consent. Severability: Invalid provisions shall not affect the remaining Terms. No Waiver: Failure to enforce any provision is not a waiver. 21.
